These terms are an agreement between you and Bleudoctype, LLC ("we," "us," or "our"). They apply when you use the eeSee website, the eeSee web application, or the eeSee Android app (together, the "Service"). By creating an account, signing in, or using the Service, you accept these terms. If you do not accept them, do not use the Service.
Accounts and eligibility
You must be at least 18 years old, or the age of majority where you live, to use the Service. An organization that uses eeSee creates or approves your account and decides what you can see and do. Keep your password private, keep your device secure, and tell your organization or us right away if you believe someone else used your account.
You are responsible for the activity on your account. We may suspend or close an account that breaks these terms, puts the Service or other users at risk, or is no longer authorized by its organization.
Organizations and work records
Assignments, schedules, event reports, photos, receipts, tallies, notes, and other work you submit through the Service are business records of the organization that assigned the work. That organization owns those records and decides how to use them. It can view, edit, export, or retain them after your access ends.
Your organization is responsible for the instructions it gives you, for the accuracy of the assignments it creates, and for its own compliance with employment, contractor, and privacy law.
Acceptable use
When you use the Service, you agree that you will not:
- Submit reports, counts, photos, or receipts that you know are false or that belong to a different event.
- Upload content that is unlawful, that infringes someone else's rights, or that contains payment card numbers, government identification numbers, or other sensitive data that the task does not need.
- Photograph people in a way that breaks the law or the venue's rules, or that your organization has not approved.
- Access or try to access another organization's data, another user's account, or any part of the Service you are not authorized to use.
- Interfere with the Service, probe or scan it for vulnerabilities, bypass rate limits or security controls, or use automated tools to collect data from it.
- Copy, resell, sublicense, or reverse engineer the Service or the Android app, except where the law allows it.
Content you submit
You keep any rights you hold in the content you submit. You give us and your organization a license to store, process, display, and transmit that content so that we can operate the Service and your organization can use its work records. You confirm that you have the right to submit the content and that it does not break the law or these terms.
We may remove content that breaks these terms. Our Privacy Policy explains how we handle personal information, including deletion requests.
The Android app
The app stores drafts, pending uploads, and session information on your device so that you can keep working without a connection. Keep the device locked and protected. If you uninstall the app or clear its storage, work that has not synchronized is lost.
The app can use your camera, your photo library, and, if you choose, your approximate location for a weather suggestion. You control these permissions in Android settings. Mobile data and roaming charges from your carrier are your responsibility.
We may update the app at any time. An update can add, change, or remove features, and a release can require you to install it before you continue.
Availability and changes to the Service
We work to keep the Service available, but we do not promise that it will be uninterrupted or free of errors. We may change, suspend, or stop any part of the Service, and we may set limits on storage, uploads, or usage. We will give reasonable notice of material changes where we can.
Disclaimer of warranties
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your requirements or that data will never be lost.
Limitation of liability
To the fullest extent the law allows, Bleudoctype, LLC and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost business, that arise from your use of the Service. Our total liability for any claim related to the Service is limited to one hundred U.S. dollars (US$100) or the amount your organization paid us for the Service in the twelve months before the claim, whichever is greater.
Some jurisdictions do not allow these limits. In that case, the limits apply to the greatest extent the law allows.
Termination
You can stop using the Service at any time. Your organization can remove your access at any time. We can suspend or end your access if you break these terms or if your organization's agreement with us ends. After termination, the sections of these terms that by their nature should survive, including the sections on work records, content, disclaimers, and liability, continue to apply.
Governing law and disputes
These terms are governed by the laws of the United States and of the state where Bleudoctype, LLC is organized, without regard to conflict-of-law rules. Before you start a legal claim, contact us so that we can try to resolve the issue informally.
Changes to these terms and contact
We may update these terms when the Service changes. We post the updated terms with their effective date and give additional notice when the change is material. If you keep using the Service after the effective date, you accept the updated terms.
